Hearings Begin Today on Kagan for Supreme Court

Dear Friends:
Today, the Senate Judiciary Committee begins its hearings on the nomination of Elena Kagan to serve as the next associate justice of the U.S. Supreme Court. Kagan’s views expressed on such critical issues as the First Amendment, the role of the judiciary, the sanctity of human life, and homosexuality should concern every American.
Here is a small sampling of Kagan’s disturbing record:
- Argued as Solicitor General before the Supreme Court that the government has the right to restrict the free speech of interest groups in campaign finance.
- Considers former Israeli Supreme Court Justice Aharon Barak, who is well-known for his extreme views on judicial activism, to be her judicial hero.
- Helped to delay enactment of a ban on the heinous practice of partial-birth abortion for several years as legal advisor to then-President Clinton.
- Repeatedly criticized the Supreme Court’s decision upholding a law allowing the federal government to bar funding from health clinics that promote and encourage abortion as a method of family planning.
- Barred military recruiters from Harvard Law School’s campus, while serving as dean, in response to her personal objections with the military’s “Don’t Ask, Don’t Tell” policy. She called the policy a “moral injustice of the first order.”

In short, Kagan leaves us with more questions than answers. And since the next Supreme Court justice will likely serve for several decades, the Senate’s decision is of enormous consequence.
That’s why your senators need to hear from you immediately!
If you share these concerns, please contact your senators and tell them to do all they can to bring out all the facts on Kagan’s record, and if she continues to hold such extreme views, to vote “NO” on her confirmation to the Supreme Court.
