Marriage Protection Amendment (S.J. Res 1/H.J. Res 39)—This constitutional amendment, which has been endorsed by President Bush but has yet to receive a vote this year, would define marriage as the “union of a man and a woman.” The text also says, “Neither this Constitution, nor the constitution of any State, shall be construed to require that marriage or the legal incidents thereof be conferred upon any union other than the union of a man and a woman.” Last year, neither house achieved the two-thirds majority needed for an amendment. To be ratified, an amendment also must be approved by three-fourths of the states.
