In recent years we have seen alarming increases in the number of individuals, many of whom are minors, undergo physically damaging “gender transition” surgeries and procedures.
In addition to going against God’s good design for sex and gender, these surgeries and procedures flaunt sound medical practice and do lasting harm to their victims. Though many states have taken action to ban these procedures, it remains legal and widely available in much of the country.
The ERLC is pushing back on recent actions from the Biden administration that would remove protections for women under Title IX to expand access to previously sex-segregated spaces for transgender individuals as well as mandate the availability of these procedures for unaccompanied immigrant children.
Public comments were submitted in response to the following regulatory actions:
- September 12, 2022: Department of Education Proposed Change to Title IX of the Education Amendments of 1972 in Regards to Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance
- October 3, 2022: Proposed Rule on Section 1557 of the Affordable Care Act (ACA) (Section 1557), Entitled “Nondiscrimination in Health Programs & Activities”
- December 4, 2023: Department of Health and Human Services Proposed Regulations Regarding Unaccompanied Children Program Foundational Rule
- May 15, 2023: Proposed Rule on Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance: Sex-Related Eligibility Criteria for Male and Female Athletic Teams
- November 27, 2023: Proposed Regulations Regarding Safe and Appropriate Foster Care Placement Requirements for Titles IV-E and IV-B
