With no ability to expand abortion access through congressional action, the Biden administration has turned to the regulatory process to push forward its pro-abortion agenda.
In 2023, the administration pushed forward changes that expanded the “contraceptive mandate,” reformed HIPPA for abortions, mandated abortions be provided to unaccompanied immigrant girls at the border, and required employers to provide leave for employees to obtain abortion. Many of these regulations will be finalized in 2024, and additional changes may be proposed.
The ERLC will continue to push back on all of these efforts alongside our partners through filing public comments and engaging in the federal rulemaking process.

- December 4, 2023: Department of Health and Human Services Proposed Regulations Regarding Unaccompanied Children Program Foundational Rule
