Update and Call to Prayer: Supreme Court Pauses Fifth Circuit Mail-Order Abortion Drug Decision

Fifth Circuit Mail-Order Abortion Drug

Today, the Supreme Court issued a seven-day administrative pause of the order from the Fifth Circuit Court of Appeals which reinstated the in-person dispensing requirements of mifepristone. This means the abortion pill can continue to be distributed through the mail for one week, until May 11.

During this pause, Danco Laboratories, GenBioPro, and the state of Louisiana must submit arguments to the Supreme Court as it considers the emergency application. These arguments are due to the court on May 7. After a week, the Supreme Court could allow the Fifth Circuit’s ruling to stand as the case progresses.

We are saddened by this temporary development but are hopeful the Supreme Court will rule in favor of life and the protection of women. We invite Southern Baptists to join us in praying to this end. Ask the Lord to give the justices wisdom and conviction as they review this case. Pray for favor, that the truth of God’s Word about the sanctity of human life would align with the constitutional arguments raised, and, ultimately, for the end of chemical abortion.

See ERLC’s statement celebrating the May 1, 2026, decision from the Fifth Circuit Court of Appeals for more information.
